Terms and Conditions
The present Terms and Conditions determine the provisions which rule the content of the Employer Membership (hereinafter The Service) concluded between College Life (hereinafter CL) and its client (hereinafter Client; together The Parties), unless other terms were expressly agreed on by the Parties in a written agreement.
- SCOPE OF THE SERVICE
1.1. The object of the Service offered by CL to the Client is to provide advertising space and additional features for listing job vacancies that are stated on the website of CL (www.collegelife.nl/jobs/employer)
1.2. CL declares to be ready to perform supplementary services of organisational and business-related support for the Client’s benefit within terms agreed on by the Parties.
- CONCLUDING THE SERVICE CONTRACT
2.1. The Client has to provide his identification data. Requested data are: full business name, address, BTW number, email address.
2.2. Client’s use of the Service is subject to creation of an account by the Client and approval by CL. CL has at any time the right to refuse or limit Client’s access to the Service prior communication to the Client. By submitting a request to use the Service, the Client represents to be at least 18 years of age.
2.3. The supply service contract between the Parties is concluded as the first job post is submitted for review by the Client, following the CL confirmation of the job post. The agreement to provide the Service between Parties shall be concluded for an indefinite period unless agreed upon otherwise in writing.
- MODALITIES OF THE SERVICE
3.1. The modalities of performing the Service by CL shall result from the kind of the package chosen by the Client and from possible special arrangements between the Parties.
4.1. In exchange for providing the Service, CL shall receive from the Client a payment of rates agreed on with the Client. These rates are available on https://collegelife.nl/jobs/employer.
4.2. The payment shall be paid in advance. Payment must be executed in the same currency in which the rates have been specified.
4.3. In the event of providing the Client with supplementary services, the CL payment for such supplementary services shall be settled according to real working time, applying the rates agreed on for the Service.
- LIMITATION OF LIABILITY
5.1. Except as expressly provided by law, CL accepts no liability whatsoever for any liability, loss, damage or expenses incurred or suffered as a direct or indirect result of the use of Service by the Client.
5.2. CL may make the provision of the Service in a given job package dependent on having been made available the access to documents or information held by the Client, while specifying at the same time the required method of making those documents or information available. The Client is exclusively liable for the accuracy and completeness of the documents or the information provided as well as for effects arising from failure to forward to CL the information or documents of significance for a given job package.
5.3. CL is not liable for damages towards the Client on account of providing him the Service. CL is not liable in any way for damages caused as a result of failure to perform or of an inadequate performance to provide the Service.
5.4. CL shall not be liable for any delay, defect or deficiency hereunder to the extent that such delay, defect or deficiency is caused by an event of force majeure which affects performance by hindering, delaying or making considerably more difficult the fulfilment of commitments of the Service. Furthermore, The Client must be present at the Service at the exact time planned; failing to do so will result in the Service being expired. “Force majeure” shall mean any circumstance beyond the control of CL such as but not limited to acts of God, accidents, loss of internet connection, or delay in delivery by any third party which is caused by force majeure.
- FINAL PROVISION
7.1. The Client agrees that any dispute in relation to your use of the website will be governed by the laws of The Netherlands and shall be determined in that jurisdiction
7.2. The Parties undertake to resolve any disputes connected with the interpretation or performance of the agreement to provide the Service by way of mutual negotiations. If it is not possible to resolve a dispute in an amicable manner, it will be exclusively competent to settle the dispute the court of Rotterdam, The Netherlands.
7.3. In connection with the performance of the Service, Parties agree to comply with all applicable laws, rules and regulations including, but not limited to data protection, and privacy laws and regulations.
7.4. These Terms and Conditions are governed and construed in accordance with provisions of Dutch Civil Code and other provisions of law which are binding in the Netherlands. For matters not governed by this present General Terms and Conditions, provisions of Dutch Civil Code and other provisions of law which are binding in the Netherlands shall apply.
